Alistar Pereira - a young lad from St. Paul's Road, Bandra is in the news for all the wrong reasons. On the other hand, this type of an accident could have happened to any one of us.
At the moment, his parents, family and close friends are in a terrible trauma over the sad situation of him getting a 3 year sentence.
- Is he being targetted because the powers-that-be feel that he has no one to really come up and back him ?
- Is he being used as an easy-to-get scapegoat by the cops to reduce rash driving in the city.
- Others who have more financial and political clout, yet have committed crimes far greater, are let off on bail and are blatantly flaunting their freedom. Is our judiciary really just ?

Motorists beware! The judgement by Chief Justice Swatanter Kumar, has sent a clear message that all roads in India, are primarily meant for sleeping, and not for driving.
It is ironical, that whilst Mr. Allistair Pereira has been sentenced to a 3-year jail term, and a fine of Rs. 5 lacs, the contractor whose labourers died/were injured, in the vehicular accident whilst sleeping on the road, has not been reprimanded.
The judgement is, also, biased in that all other fatal driving accidents, including Salman Khan’s (2002), Pura Raj Kumar (1993), Neel Chatterjee, Sanjeev Nanda, P.A. Mhatre, even Tanuja have been charged under “rash and negligent act” only, Pereira has been charged under “culpable homicide, not amounting to murder”.
Chief Justice Swatanter Kumar, should explain this anomaly.
Finally, whilst no one grudges the granting of bail, to convicted criminals like Navjot Singh Sidhu (homicide), Sanjay Dutt (Arms Act, related to bomb blasts), and Salman Khan (killing the endangered Cinkara deer), it is a mockery of the judicial system that after a pure accident, a 21-year old boy, Allistair Pereira, is being denied bail.

I fully agree that the punishment is far too severe for the crime committed.
Punishment for drunken driving an accidental death of of people calls for a lighter punishment. Certainly not. Three years of rigorous punishment.
He has wrongly been booked for culpable homicide not amounting to murder, which is normally used for premeditated and planned killing of somebody.
The point is, what action are you going to take in conjunction with the BCS, church and community?

Our so-called authorities are just taking undue advantage of this known fact. Do we want this situation to continue, whilst one of our very-own Bandra-boy is languishing in jail - in his youth, scarred and shattered because we do'nt have the guts to at least SAY something...
The DNA of 7th September 2007 has reported that Alistair Pereira has been given a very harsh and unfair judgement. Yes, no doubt, Alistair should be punished but not so severely under Section 304 Part II. Unfortunately, he has been treated like any other hard-core criminal whose aim in life is to murder knowingly… these are the criminals. Not a youngster or for that matter any youth who has been caught for the first time in rash driving.
It is a pity when there are umpteen cases similar to Alistar’s, whether killed 1 or mowed down 8, under the influence of drink and rash driving. Most of the cases have gone scot-free with just a pittance fine of Rs.30,000/- or least still Rs.905/-, etc. etc. as stated in the DNA dated 7th September 2007. Is it due to their high clout and influence? Some are given bail, some of these cases dragged on for many years, but Alistar was on a fast track court, and for his first-time negligence for rash driving, he has been wrongly convicted under Section 304 Part II on the serious charge of culpable homicide not amounting to murder which is pre-planned or per-meditated murder. And, Alistar was given 3 years of rigorous imprisonment alongwith hard-core murderers.
If this rash driving is repeatedly done, then yes, this judgement could be given to him. However, he has, been wrongly booked under Section 304 Part II. We are sure considering the eminence and fairness of the Supreme Court Judges, they will realise that he should be booked under Section 304 A for rash and negligent driving and certainly not under Section 304 Part II which requires that the crime be pre-planned and pre-meditated, which certainly was not the case.
With construction work in progress on Carter Road for months on end, it had become very difficult for people to drive during daytime leave alone during the night when lighting is bad and the construction material strewn all over the place. Why should the labourers be sleeping on the road in the first place ? They should have been given temporary tin-shed shelter in a safe place and not allowed to sleep on footpaths/roads, and hence this imposes a legal obligation on all vehicles to move slowly at night time. “Since when have the roads and pavements become a shelter for the homeless slum dwellers, the labourers, the beggars ? Are we, the public, paying Municipal Road Taxes to allow these migrant workers to live/sleep on the roads?” Many-a-times, on our return from a late night show, our taxi has narrowly missed running over these pavement dwellers sleeping on the road. “As though the road belongs to them !”
This is a WAKE-UP call for all our motorists to realise that the rights of the road now also belong to the slum dwellers, labourers, beggars & vagabonds, who are allowed to sleep on the roads; and be cautious in your driving whether you had a drink or not.
It is strange to note that according to statistics given in the newspapers, 4436 people were booked for drunken driving in the past 3 months, and there was a decline of only 200 accidents in the past 3 years. I would like to know how many of these offenders were given the same kind of punishment as meted out to Alistar, under the various charges. The Advocate General very rightly stated that all hit-and-run cases have to be probed in all their dimensions and he also suggested that the judges have to frame guidelines for investigations. Was this taken into account for all hit-and-run cases? In the case of Alistar, it was not a hit-and-run case. He went to the Additional Police Commissioner’s Office at Carter Road and informed them of this incident.
It was a clear case as was stated earlier by the Adhoc Sessions Judge in his order… his wheel came out, his engine failed and he could not control the car; maybe, also due to the construction material lying around or the dim lighting. His evidence given from day 1 that his engine failed was not taken into consideration. Was the judgement really beyond doubt? Why was the R.T.O’s examination not taken into consideration? It seems that it is falsehood. Was it proved beyond doubt that his engine was in perfect condition… or was the Judge carried away by the media sensationalizing the case and wanted to be in the good books of the media?
I am sure that many senior, responsible people who drive home often after a drinking party. Let’s not only nail the youngsters as though they are the culprits, and the older folk are blameless.
I am glad that the Traffic Police are now watchful. This should have been monitored years ago. But thank God, better late than never ! May be, if this was done 5 years ago we would have saved hundreds of lives that have been lost because of drunken driving, and Alistar, Salman Khan and others wouldn’t have been targeted and put in this tight spot.
